INTRODUCTION
This Copyright Notice & Takedown Policy should only be used to report content that has been published on FantasyDigital.co that is infringing on intellectual property rights of copyright holders. Please get in touch with us at https://www.fantasydigital.co/contact-us for assistance in removing illegal content that has been identified on other websites.
We recognize the intellectual property rights of copyright holders despite the fact that Fantasy Digital (the "Platform") is based outside of the United States, which is why we have opted to voluntarily adhere to the Digital Millennium Copyright Act's notice and takedown requirements ("DMCA") or any other applicable intellectual property legislation or laws. We do not permit copyright infringing activities or infringement of intellectual property rights on our Platform and will promptly and without prior notice remove all content if properly notified of infringements on third party’s intellectual property rights. Repeat infringers will have their access and/or privileges terminated.
Fantasy Digital qualifies as a “Service Provider” within the meaning of 17 U.S.C. §512(k)(1) of the Digital Millennium Copyright Act of 1998 (“DMCA”). Consequently, it is entitled to a certain protection against claims of copyright infringement under the DMCA, commonly referred to as the “safe harbor” provisions.
Web3 and Blockchain Content:
Fantasy Digital operates as a front-end interface for content that may be stored on decentralized protocols. While we can remove or disable access to infringing content on the Fantasy Digital platform (our website and UI), we cannot remove data from the blockchain itself. Our enforcement is limited to 'de-listing' or blacklisting infringing content from our platform.
NFT Enforcement:
In the case of infringing NFTs, Fantasy Digital will disable the display of the media and reserve the right to blacklist the associated smart contract or token ID from appearing in our search results, marketplace, or user feeds.
For users in Canada, Fantasy Digital complies with the 'Notice and Notice' regime under the Canadian Copyright Act. We will forward notices of claimed infringement to the relevant user and maintain records as required by law.
FILING A NOTICE OF COPYRIGHT INFRINGEMENT
If you believe that your copyrighted work has been reproduced and published on the Platform in a way that violates your copyright, kindly give the following information to our designated Copyright Agent:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Please do not send our Designated Agent any additional questions or information. Only content that has been published on our Platform is covered by this policy. Any agency relationship beyond that necessary to accept legitimate DMCA Notices is expressly disclaimed, and our Designated Agent is not permitted to accept or waive service of formal legal process without our prior written approval.
If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.
Abuse Notification
Abusing the DMCA Notice procedures set forth above, or misrepresenting facts in a DMCA Notice or Counter-notification, can result in legal liability for damages, court costs and attorney’s fees under U.S. federal law. See; 17 U.S.C. §512(f). This Notice and Takedown Procedures only apply to claims of copyright infringement by copyright holders and their agents – not to any other kind of abuse, infringement or legal claim. We will investigate and take action against anyone abusing the DMCA notification or counter-notification procedure. Please ensure that you meet all of the legal qualifications before submitting a DMCA Notice to our Designated Agent.
COUNTER-NOTIFICATION PROCEDURES
If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. To be effective, the counter-notification must be a written communication provided to our Copyright Agent that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under DMCA 512(c)(1)(C) or an agent of such person.
REPEAT INFRINGERS
In accordance with the applicable laws, it is our policy to restrict, terminate or disable, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.
